3.1 Entry and participation in any contest shall be deemed unconditional and irrevocable acceptance of these T&C. All entry instructions and any other specific details relating to the contest or the prizes form part of these T&C (but in the event of any conflict or inconsistency, these T&C shall prevail).

5.1 All Participants MUST be 18 years and above at the time they entered the contest and citizen of India and/or permanent residents of India and, if requested by , shall provide proof such as Aadhar card, Birth Certificate, Drivers License etc. of the same. In the event the participant is below 18 years old their participation must be supervised by their parents or legal guardian and in such case will not be held responsible for the same.

In the case of contests which require Participants to submit audio/video recordings, Participants grant to Vamona Developers Pvt Ltd the unconditional and irrevocable right to broadcast the audio/video recording(s) submitted by Participants by live or deferred transmission in all formats (including, without limitation, analogue, digital, internet, cable, satellite and telephony broadcasts, social media, etc.). This shall include the right to alter, edit and compile the audio/video recording in any way whatsoever. Participants confirm that the use of the audio/video recording submitted does not infringe any third-party rights and shall indemnify Vamona Developers Pvt Ltd for any loss, damage, or liability arising in connection therewith.

1.2

Participants who submit audio/video recordings represent and warrant that they have the right, power, and authority to grant the rights set out above and that they have obtained all necessary consents and permissions in respect of the same.

1.3

For the avoidance of doubt, all rights in the name and title of the Contest and the format rights for the Contest shall vest exclusively in Vamona Developers Pvt Ltd for its own use and at its absolute discretion.

Vamona Developers Pvt Ltd – Exclusion of Liability

2.1

Vamona Developers Pvt Ltd shall not be liable in any way for any costs, expenses, damages, liabilities, or injuries arising out of or in any way connected with the Contest or prizes, other than those costs and expenses specifically provided for as part of the prize (if any).

2.2

Vamona Developers Pvt Ltd accepts no liability (and excludes all liability) for any loss of profit, business, contracts, revenues, or anticipated savings, or for any special, direct, indirect, or consequential loss of any nature whatsoever and however arising.

2.3

Vamona Developers Pvt Ltd shall not be liable to perform any of its obligations under the Contest or in respect of the prizes where it is unable to do so as a result of circumstances beyond its reasonable control or due to force majeure events, including but not limited to fire, accident, riots, flood, earthquake, storm, terrorist activities, war, acts of God, any order, circular or regulation of any government or governmental agency, pandemic, or similar events. In such circumstances, Vamona Developers Pvt Ltd shall not be liable to compensate Participants.

You agree to defend, indemnify, and hold Vamona Developers Pvt Ltd, its officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorneys’ fees and costs, arising out of or in any way connected with:

(i) your access to or use of the Application or Services;

(ii) your violation of these Terms; or

(iii) your violation of any third-party right, including without limitation any intellectual property right, publicity right, confidentiality obligation, property right, or privacy right.

Failure by us to insist upon strict performance of any provision of these Terms or any other agreement, or the failure by us to exercise any right or remedy to which we are entitled hereunder, shall not constitute a waiver of such right or remedy and shall not diminish our rights or your obligations under these Terms or any other agreement.
